I reckon this whole thing has nothing to do with drink driving and the two coppers were just massive fans of the FA cup...

It's pretty obvious to the trained eye that on being pulled his damage limitation grey matter kicked in rather quickly and to fail a test would be seen as pure stupidity but to cry harrassment and not take one would possibly give him leeway to fight his corner and try to prove what innocence he may or may not have, despite that, in this country, you refuse to blow the bag then you get a mandatory 12 months if you get the right brief and the right JP on the day, Kits best hope he's not an old school referee with emotional ties to the FA Cup.

So does that mean that the police can just stop your car if you are driving along and insist on giving you a roadside breath test? The answer is NO.

They are entitled to randomly stop your car, but they can only insist on a breath test if they have reasonable cause to suspect you have committed a traffic offence, or have consumed alcohol (eg they can smell it on your breath), or they reasonably believe you have been involved in an accident (eg the description of your car matches that given by a witness).

So when you are convinced you have done nothing wrong presumably you can refuse to give a sample??

Royalee, still visably smarting from the hilarious stinging issued by platypuss on the Lescott thread.

Kitson is a great player and has been class for us this season. This however, does not entitle him to drink and drive im afraid.

Good old 'Law on the Web'

Firstly, under our legal system, the accused is innocent until proven guilty. Secondly, there is a 'reasonable grounds' defence to this charge. As none of us can be sure exactly what took place, speculation, though tempting, is pointless.

One thing we can be sure of is that Kits will have a top defence team.

And...on the subject of points. If convicted, a minimum of 12 months ban. However, guidelines to Magistrates are now suggesting bans of 18 or even 24 months. There is also an option of an additional 6 months imprisonment, although this is in practice, reserved for repeat offenders.

Will be interesting to see the outcome of this, there will be a lot of press at the court on friday.

Kitson has acted foolishly, of that there seems no doubt, some on here seem happy to hang folk for DD yet want to allow Kitson off in some way.

DD kills less people on the roads than speeding, yet is still not stigmatised like DD is.

Anyone of us that drives after having a drink is a drink driver, but most of us believe we are under the limit, we know when we are speeding though, and probably do it more often and deliberately.

As for the comments re Tredds fishing, not at all, he passed on news, cant see much gloating in it either.

Good luck DC, take the punishment. learn from it and move on, I for one support you.

Remind me not to take you on a fishing trip then, empty net ahoy.

All i've done is merely pass on confirmation of said rumour from the previous day, you may construe that as a fishing trip, i'd like to think of it as a public service, just like the wonderful TVP have performed.

Tredds - TBH, I couldn't give a toss if you're fishing or not - I was just quoting you where you said you'd had too many fish from this section already. I took this to be an admission of the fact you were fishing so forgive me if this isn't the case.

Does the thread originator not have a drink-drive conviction of his own? :D

I hope you can substantiate that scurrilous accusation! We don't want this thread being deleted do we?
