Yeah, because that's going to happen. The whole point of an out of court settlement is to avoid the hassle and publicity of a Court case. So they are hardly going to sue for breach of contract in those circumstances. Especially because it changes from beign a moron with a spurious case against the club, to a multi-million pound company suing an individual who is a fan of that company.

Talk about awful awful publicity.


I wasnt suggesting that the club should be suing him I was just answering how gagging clauses work

Thanks, Mike. I didn't know how they worked, but Ian's got a point in that it would bring even worse publicity to the club and more hassle.

I just don't see the point in gagging orders in such cases, they're essentially worthless as everyone knows they aren't going to be enforced with Court action.

It'll cost them to come to Sydney if they want to defend themselves!
