Geekins
Stranded Hearing scheduled for the 3rd August.

Typical - Before the new season so they could get away without a points deduction

Or be liquidated, fingers crossed.

Dirk Gently From talking to a group of Pompey fans this weekend it appears that at least some of the disputed sum is for tax on payment for "image rights" - HMRC see this as a test case, and if they win with Pompey the sums they'll be able to claim from PL clubs will be phenomenal.

That'll certainly do the public purse some good so I hope HMRC wins.

Fingers crossed for an old school, football hating judge and a fair hearing....

The case is over the question over whether the money claimed by HMRC on image rights paid to foreign accounts can be included in the calculation used to determine the debt percentage for CVA approval. HMRC are asserting that it should while Portsmouth will argue that this legal principle has not been established.

Now currently the legal principle of whether these payments should attract UK tax is indeed not settled. Is this case actually being asked to rule on the whether these payments should attract UK tax or only on if disputed payments can be included in CVA calculations?

Maybe you cannot answer the former without declaring on the latter but my fear is that the judge will say that this legal principle is not yet established so the striking out the 13 million in debt from the calculation was valid.

Given that precis, I personally think either way that HMRC will lose.

How on earth could they justify a USA tour playing some key games last week? What is wrong with playing some games in Devon!!

It takes longer to get to Devon at this time of the year, what with the caravans and stuff...

As has been mentioned in many places, the US tour cost them nothing. It was paid for by their hosts/tour sponsors.

Who would actually pay for Portsmouth to visit them? I'm sure thats just how the Administrator has spun it.

I guess they were a Prem team when the tour was arranged (probably last summer) so a lot of people would have done.

Case adjourned so that the judge can read through the new papers submitted by the HMRC - should recommence this afternoon.

In other news Pompey will not have any live commentary this season due to their excessive demands......

I'm getting right royally f**ked off with the PFC situation. We all know they'll walk away from this and kick off on level terms with us this Saturday, playing players they "bought" with money they never had, from teams that they still owe money to. Whereas we'll keep the same tight ship as ever, yet on paper, our starting 11 is equal at best. Meanwhile, Jones the Printers and Evans the Pie Suppliers have to make do with 20p in the pound over 5 years! Where's the fairness in that? I'm really hoping that the judge is on the "enough is enough" side and they get wound up, but it ain't gonna happen.

What sticks in the craw that as a small businessman myself, I get a letter if my VAT is overdue by a few days (twice in 12 years - once down to their website crashing, once down to me being in hospital). I can only imagine what it would be like if my PAYE, NI and VAT were overdue to a comparable amount as PFC.

Still, at least I can sleep at night knowing that I didn't use St. John Ambulance money or cash collected from buckets for charity to help pay player wages. Mind you, I don't sleep in a multimillion pound house on the south coast...

I hope that analysis just has some portsmouth bias to it.

A lot of wish fulfilment, but there is a link at the bottom to a quite reasonable discussion.
