Ermmm, just FTR, if there was masses of evidence and it was an open and shut case, what else would the Police have done than hand the file to the CPS?

For the more law/media attached people, should the allegations about JT be thrown out by the CPS, i assume this just means that he won't be prosecuted by a court of law.

Would the FA still have to try Terry, and make a 'Guilty/Not Guilty' decision, akin to what has just happened to Suarez?

They would presumably (wrongly) say that if the CPS don't have the evidence to charge him, then the case is closed.

Interesting that in October the Guardian wrote this:

...barring any new evidence such as new video footage from a different angle, there is not enough material for the FA to charge Terry with anything. A member of the public has filed a complaint, Terry denies any wrongdoing and there is no hard evidence either way. There is also the fact that the video evidence does not pick up the whole of the incident, so Terry can say that the context of what he said is not captured fully.

The FA banning Suarez for something not (apparently, at this point) proven by video footage seems to tear that argument up altogether.

It all seems to be edging towards another 'old scholl tie' fit up, and he'll not be charged with anything, as i said, the moment it went to the CPS, that was the end of it.

I just thought that because it was in the hands of the CPS, then they would either prosecute him or not, but the FA still had to decide what punishment (if any) they would deliver.

If it's a case of, CPS to decide, then he's off scott free.

I'm of the opinion that whilst the CPS will view the case from the perspective of "Can we secure a conviction?", the FA aren't under the same rules of "beyond reasonable doubt"; Terry has admitted he said what he said - his defence is the context of why he said it. In that way it appears (to me anyway) that it is identical to the Suarez case - which at no time had the suggestion of enough evidence for the Police to contemplate asking the CPS for a prosecution.

In other words, IF the CPS this afternoon state that there isn't enough evidence to charge Terry with an offence (as I strongly suspect they will, because the CPS are only viewing it if they think that they will get a conviction) that will not stop the FA from charging Terry.

But where is the difference between this and Suarez, the FA didn't sent the Suarez case to the CPS, why would they send the Terry one, other than the police wanting to prosecute Terry in a court of law.

The FA should still charge/not charge Terry, irrespective of whether the courts think it's a chargable offence or not, or am i reading this all wrong?

CPS advise prosecution.

There's been some real corking predictions back firing so far on both this and the Suarez thread.

JT to appear at a Magistrates Court on 1st Feb. Maximum fine £2,500. FA to decide if JT has a case to answer - which now seems more likely. My money is on the FA waiting for the outcome of the court appearance before making a statement.
